NDIS no contact rules start 1 October 2026
The Securing the NDIS Future Generations Bill included a bunch of changes, many of which we have already talked about here. Well, there’s another change included in the legislation that will go live from 1 October, and we want to make sure everyone knows that it’s coming.
New contact rules
Essentially from 1 October the NDIA have the power to suspend a person’s NDIS plan if no response is received after a set amount of contact.
If no response is received 90 days after the plan is suspended, the NDIA can revoke a person’s status as a participant.
More detail on the contact process
When the NDIA attempts contact, they must so in the correct way and in a specific timeframe, so:
- The NDIA must make at least five attempts to contact you, using your preferred method of communication.
- The NDIA must make one additional attempt, in writing, if your preferred contact method is not in writing.
- The fifth (and final) contact attempt must happen no earlier than three months and no later than 4 months from the 1st contact attempt.
- If you are in hospital, “another institution” or experiencing homelessness, these attempts to not count. However, you will need to notify the NDIA if any of these circumstances apply to you.
- Any decision made by the NDIA is reviewable, so should your plan be suspended or your participant status revoked, you have the right to challenge these decisions.
What you can do
Keep the NDIA updated of any change of life situations (hospital etc.), make sure you know what your preferred method of contact is and keep an eye on it.
For providers, nominees and other in the wider support team, keep the people in your life up to date with these changes and informed of how the process works.
